ENCONTRONAZO ENTRE LA SCJN Y LA CONSEJERÍA JURÍDICA DEL EJECUTIVO FEDERAL

El decreto.

Encontronazo entre la SCJN y la Consejería Jurídica del Ejecutivo Federal, esto en un estado democrático no es de alarmarse, todo lo contrario; pues hace evidente que existe un debido balance de pesos y contra pesos.

 

Lo anterior ocurrió después de que en días pasados presuntamente se filtrara un supuesto proyecto del ministro Pérez Dayan donde se dejaría sin efectos la primera parte del llamado plan B, es decir aquellas reformas aprobadas a finales del año 2022, donde se modificaría la Ley General de Comunicación Social y la Ley General de Responsabilidades Administrativas.

 

La consejería jurídica del Ejecutivo Federal como respuesta dio a conocer el comunicado donde solicita a la SCJN resolver impugnaciones en contra de la LG de comunicación social publicada en el 2018 e impulsada por las bancadas del PRI y del PAN, recordemos que esta Ley General fue duramente cuestionada por la minoría del senado y la CNDH, pues argumentaron que existieron vicios en el procedimiento legislativo, derivando la promoción y aceptación de una acción de inconstitucionalidad por parte de la scjn, pues dicha ley, no era de carácter electoral.

 

Actualmente la Consejería Jurídica argumenta que la SCJN después de 5 años de impugnarse dicha ley no se ha pronunciado, caso contrario, a la primera parte del plan b que a menos de 6 meses de impugnarse y de acuerdo con la filtración del proyecto de la ponencia Pérez Dayan, ya tiene posible resolución respecto su constitucionalidad.

 

Por lo anterior, la Consejería Ejecutivo Federal solicitó formalmente a la ministra presidenta de la Suprema Corte de Justicia de la Nación, Norma Piña, se pronuncie primero sobre la constitucionalidad de la ley general publicada en el viejo régimen, es decir en el 2018, y posteriormente sobre la constitucionalidad de la primera parte del plan b, aprobado y publicado a finales del año del 2022; esto con el objetivo de que no vayan a existir sentencias contradictorias respecto la constitucionalidad de una misma ley y sus modificaciones.

 

Es importante mencionar que la solicitud de la consejería no solamente es viable, también es necesaria jurídicamente hablando, pues la SCJN tendría que pronunciarse de la ley genera en su totalidad, por considerarla principal y las reformas del 2022 como accesorias, pues una regla lógica-jurídica es aquella que dice que lo accesorio sigue la suerte de lo principal y no al revés; esto, desde luego, si se atiende a los principios y prelación de solución de controversias apegados al derecho.

 

De no ser así, se vulneraría el principio de certeza jurídica y estaríamos viendo una vez más la resolución de casos priorizando los intereses políticos y no jurídicos, prevaleciendo la ideología de partidos y no el estricto derecho y sobre todo; la justicia.
